A federal choose sanctioned 3M for abruptly switching its legal responsibility arguments within the fight earplug litigation in a transfer she known as a “brazen abuse of the litigation course of” and the “epitome of dangerous religion.”
U.S. District Decide M. Casey Rodgers of the Northern District of Florida ordered that 3M couldn’t argue going ahead that its subsidiary, Aearo Applied sciences, which filed for Chapter 11 bankruptcy on July 26, was the only real defendant responsible for the allegedly faulty earplugs. Lawsuits alleged the earplugs induced listening to loss and ringing of the ears.
