Former President Donald Trump isn’t shielded from legal responsibility in civil lawsuits stemming from the Jan. 6, 2021, U.S. Capitol riot if his speech earlier than the occasion “inspired imminent personal violent motion and was prone to produce such motion,” the U.S. Division of Justice mentioned in a quick filed with a federal appeals court docket.

The March 2 brief, filed with the U.S. Court docket of Appeals for the District of Columbia Circuit, mentioned the DOJ was expressing no view on allegations that Trump’s speech incited the riot. But when the allegations are true, Trump shouldn’t be shielded, the DOJ mentioned.

Trump had claimed that he had absolute immunity from the civil fits over the assault on the Capitol. The fits have been filed by 11 Democratic members of the Home of Representatives and two Capitol law enforcement officials, in response to the Washington Post.
